Who pays in Southampton

Buyer, under New York Tax Law section 1449-dd. If the buyer is exempt the seller must pay.

What catches people out

The $400,000 allowance disappears entirely once the price passes $2 million, so a $2,000,001 sale pays 2.5 percent on the whole amount. First-time buyers can apply to the town for a further exemption. Commercial property gets no allowance at all.
